Bail Parole and Furlough Explained Know the Legal Differences 320 There are three legal ways to get out from behind the prison bars. But all three are completely different from each other. Do you know about them?

Hello Friends! Welcome to our website. Most people might have heard or might be aware of bail. It is often heard that a person has come out of jail on Parole and very few people might have heard the word furlough.

Actually these three words seem similar to a common man. But there is a lot of difference between these three. We will try to understand these differences in today’s blog. So let’s start without any delay.

First of all let us talk about bail which is called bail in Hindi and which a common man understands. But does he really understand it? No problem, we will try to understand this in a simple way. So bail is granted to a person who is accused of something and his case is still going on in the court.

Trial can be pending in the court and appeal can also be pending. But bail is granted only in a pending case. The person against whom a case is going on is called accused or accused. And bail is always granted to the accused. To simplify it, bail is a type of guarantee or assurance given by another person to the accused that whenever the court summons the accused, he will appear.

So the important things you should know about bail are that bail is granted to the accused before or during the trial. It is the discretion of the court to grant or not grant bail to an accused. So, especially for the word bail, keep in mind that it is for the accused person and is granted during the trial.

Now let’s talk about Parole. So any person who has been sentenced by the court and is serving the sentence and due to some special reason he needs to come out of the jail, then the person serving the sentence can apply for Parole.

The decision to grant Parole to a person is taken by the government. So you can understand Parole as a temporary release from jail for a few days for the person serving the sentence. But this leave i.e. Parole can be granted only in special circumstances and for special reasons.

Like if there is a death of a person in the family or a family member is getting married or a family member is suffering from a serious illness and is in a serious condition, then the person serving the sentence can apply for Parole to meet him.

It is important to understand that Parole is not a right. Granting or not granting Parole is the discretion of the government or the Parole board. This can also be refused. And most importantly, the time spent on Parole is not counted in the sentence.

Suppose the total 10 If you are sentenced to a year and get Parole for a month in between, then you will have to stay in jail for the additional period of time spent on Parole. So, review the main points for Parole once. First, Parole is granted to a prisoner who is serving his sentence. Second, it is granted only for a specific reason during the sentence.

Parole is not a right but a discretion of the state government and the period of Parole is not counted in the sentence. Now in part three, let us understand furlough. Most of the viewers may not have heard this word. However, its nature is a bit similar to Parole because furlough is also given to such a prisoner who is serving a long sentence in some cases. But its meaning is different.

This means that furlough is given to a person serving a long term sentence so that he can maintain contact with his family and society and take a break from prison life. There should be no specific reason for furlough, such as someone’s death., There is no need for illness or marriage etc. This is in a way for the reformation of the prisoner.

The Biggest Difference Between Furlough And Parole

The biggest difference between furlough and Parole is that the period spent on Parole will not be reduced from the sentence. This means that the prisoner will have to stay in jail for the additional time for which he was on Parole. But if a person is granted furlough, then the time spent by the prisoner on Parole runs along with his sentence.

Meaning, suppose a prisoner is granted two weeks of time as furlough, then the two weeks spent by the prisoner on furlough will be considered as continuation of his sentence and he will not have to stay in jail for any additional period. So, the first thing to note about furlough is that furlough is given with the social objective of keeping the person serving a long-term jail term connected with the society and family.

There is no need for any specific reason for furlough as it is just a break from the jail. If the prisoner has good conduct then he can apply for furlough and lastly the period spent on furlough is counted in the sentence. Compare all the three things and explain in one line then bail is given by the court to the accused person during the trial.

Parole Can Be Granted By The State Government – Know The Legal Process

Parole can be granted by the state government to the convicted person during the time of serving his sentence if there is any special reason and the time served in Parole will not be included in the sentence. Lastly, furlough is given to prisoners serving long sentences as a social break for which no special reason is required and its time is counted in the sentence.
